TIF talks with city attorney

The Monett Tax Increment Financing (TIF) Commission held a meeting for more than 90 minutes with attorney Mary Jo Shaney at Monett City Hall on Monday.

The session was closed to discuss litigation. No action was taken.

According to TIF Chairman Mark Nelson, a motion has been filed with the Southern District Court of Appeals by Barry County, Lawrence County and the Barry County Emergency Services Board to appeal Judge Neal Quitno's ruling in favor of the City of Monett.

The court grants 90 days to file the full appeal, giving the counties until early November to submit the text of their argument. The appeal text has not yet been filed.

For the appeal, the Cassville law firm of Ellis, Cupps and Cole is handling the case.

Shaney reviewed how the appeals process worked and walked the TIF commissioners through several scenarios on how the case may proceed.
